Data Protection and Terms of Use

The Medical Research Council Brain Network Dynamics Unit at the University of Oxford (MRC BNDU) requires names, email address and institutions of the Data Sharing Platform user account holder (User) to be stored to record their agreement to the terms and conditions of use of datasets, which forms a contract under English Law. Under General Data Protection Regulation (GDPR), MRC BNDU justify this use with a lawful basis of a contract (or information needed to take steps which might lead to a contract, initiated at the request of the User) [GDPR Article 6(1)(b)].  A contract for the transfer of a dataset exists when the User reads the terms and conditions and clicks 'Agree and Download'. A record of this contract is stored. The personal information is processed before a contract exists (before the User has downloaded a dataset) to allow an eligibility for access judgement to be made before access is offered to a requested dataset; to allow contact with User to make them aware of a decision, and if a negative decision, offer them the opportunity to appeal.

Personal data of Users may be passed on to the Medical Research Council, UK Research and Innovation (MRC) who provide funding to the MRC BNDU. In these cases, the legal basis of this processing of personal data is a public task [GDPR Article 6(1)(e)]. The MRC is a public body that distributes taxpayers' money, and the processing of the information is to assess the effectiveness of public investment.

Use of this web site is governed by these terms; if you do not agree to them, then do not use this web site. These terms are governed exclusively by English Law.
